But who actually owns the tailings they claim is theirs ? Is there aa surety they are owned by the mining company ? it may claimed to be when it's not actually the case.
Tailings are to be returned to the site from where they came. The question is, If that site from where they came does not belong to Iluka, who owns those tailings? Tailings are to be returned to that site and there is the legal and financial obligation of the mining company to rehabilitate the site back to pre mining condition of arable farmland. Another question is, how can a mining company be offering something as collateral if they may not actually own that product?
Now what has to be looked at and investigated is if the cost to rehabilitate mine sites exceeds the value of the company, what is the position of that company ? it would appear to be dubious.
