• Investa office fund - tov: iof Investa Office Fund - panel decision
• Satisfied acquisition of control over voting interests in iof was not taking place in efficient, competitive and informed market
• Considered IOMH document did not disclose readily and reasonably interests that manager had when advocating the position adopted
• While consideration of application,concern was raised whether other statements in iomh document were misleading
• Proxy form attached to the IOMH document, although valid, was likely to mislead or confuse iof unit holders
• Panel was not satisfied that these concerns properly formed part of the application
• Was not satisfied that sufficient basis had been established to interfere with voting rights attaching to units in IOF
