James Hardie Industries SE (ASX:JHX) has won an appeal to the Federal Court regarding a decision that it owes back taxes of about $307 million.
The full bench of the Federal Court, found in favour of RCI Proprietary Limited, a subsidiary of James Hardie, overturned the Federal Court's earlier rejection of the appeal.
The matter relates to a tax assessment from 1999.
RCI was issued with an amended tax assessment in 2006, to which it objected.
The objection was disallowed by the Australian Taxation Office.
James Hardie Industries SE (ASX:JHX) reported a loss of $336 million in the six months to March this year.
