Or the basis of a successful lawsuit. Lynas and her shareholders invested a great deal of money in a plant with that fact known. Reneging on an agreement under these conditions cannot, IMO, survive unbiased scrutiny. LYC had to sue to begin operations, at great expense to shareholders, but won in Malaysia courts.
