If we start being too zealous in punishing those who make honest mistakes then you risk creating a culture of hiding mistakes. It's better to encourage openness about mistakes and focus on trying to understand why things went wrong and how they can be prevented. If the government wants the banks to become de facto law enforcement authorities, maybe they should consider embedding some staff to help out.
