mediation is really compulsory these days in supreme court matters. If you dont go to mediation and you win something like the other side intended in the mediation then you may not be entitled to all the legal costs when the case ends.
On the other hand if you do go to mediation and what you propose at mediation and is rejected by the other side will be a good arguement for a significantly higher costs order.
Dont anyone get hopes up that this case will get going before 2010. The mediation is a legal costs game - and so far chm costs are being drained away.
