I have had a lot of experience dealing with "contract enforcements" in mining and electricity industries in Europe and in Australia. For what this is worth, I believe NLI should start the legal process, but continue negotiations. NLI has nothing to lose by doing this if they believe their legal position is strong. Continued "threats" and references to "we may go to court" can easily be taken as bluff or an empty threat. They have not stopped NLI having to extend their trading halts on 3 occasions so far. If NLI is in a strong position, or has a reasoanble arguable case, they should act without delay to enforce their rights by commencing court proceedings. That will force the other side to either "put up or shut up". Nothing better to focus the mind than litigation. NLI can always settle their court case if an agreement is reached. That's my view !
