Due to continuous disclosure requirements, it is almost certain that the joint-release will be made prior to FIRB approval.
It is standard practise to announce a deal subject to FIRB approval, particularly there are no-risks of the FIRB rejecting the investment proposed by the farminee.
Judging by the proposed deal by one of the unsuccessful farminees amounting to 9-figures, I don't think we are looking at a dud deal.
