IMO
Pure deduction.... if the reasons were justifiable under the law - they did not have to agree to the consent order and litigate it infront of the Justice - WE (ie Labor Govt) agree with the reasons set out in the NOIR/Refusal.... putting aside Scomo's bias... the reasoning stands and we want you your honour to rule on the Refusal. OR..
If they had no opportunity to defend it due to Scomos bias.. then why after 18 months have they not refused it with the same reasons?
Bias of a persons opinions is not something that rules you out from making a decision - whether you like it or not. Its the decision it self and the reasoning with it that needs to stand the test of the Courts. IF not - then there is probably no one in Govt who can make any decisions - especially regarding PEP11.
For example...- if Scomo had approved the application - what then????
