The problem with your argument, is that you fail to recognise that the criminal elements role in drug production and distribution, decreases with legalisation.
There just aren't the profits available to maintain their enterprises.
Just like booze and cigs, there will still be some criminal involvement, but peanuts compared with now.
As far as the tens of thousands dying, there might be an increase in using, but who cares, if the overall harm done[health, crime, mortality] is likely to plummet.
