Yep, as long as the regulator is convinced. Just like the 'potential' zone of compartmentalization near LD-1 and LD-2.
We've seen this play before - call it a conservative interpretation due to potential conflicting information or whatever, but knowing that the high likelihood is that both sections of the reservoir are happily connected.
Then we can kill 2 birds with 1 stone, call NED-1 an exploration well to keep the regulator happy and suppress the data a bit longer, so that a T/O meets a high risk interpretation and puts off the big sharks until NWE and ERL are happy with the volume of data they will present to RISC. Get a good reservoir 2P value back and then off to market to lock in supply contracts and push the company evaluation up through the roof, while wearing the finest threads.
My guess, November next year we get RISC back and ERL + NWE go to state gov for a production license and export permit, while working up export market options. This will have to happen quickly otherwise we could be pinched at unfair value.
