The Federal Government has officially rejected a permanent visa application from a 104-year-old Chinese woman who has lived in Australia for the past 10 years.

Cui Yu Hu arrived in the country on a visitor's visa in 1995 but could not return home after airlines believed she was too old and frail to make the trip.

This morning the Migration Review Tribunal, the government department responsible for disputed visa applications, formally rejected Mrs Hu's last-gasp bid to stay in the country.

"The Migration Review Tribunal affirmed the decision under review, finding that Mrs Hu is not entitled to the grant of an aged-parent residence visa," a tribunal spokeswoman said.

The matter will now be referred back to the Immmigration Department, which will decide if Mrs Hu is to be deported.

Chap Chow, a spokesman for Mrs Hu, told ABC Radio that the 104-year-old would apply directly to Immigration Minister Amanda Vanstone to be allowed to stay in the country.

"A lot of people know that in public the minister has already has already said she would consider this case with compassion," Mr Chow said.

"In fact the prime minister himself is on record as saying this case deserves some compassionate treatment ... so we are quietly confident this will be the outcome."

Mr Chow said Mrs Hu had no family back in China, and had outlived all her other friends.

"Imagine if you put her in an immigration queue - it will kill her."

Immigration department spokesman Terry Walls said, under Section 351 of the Migration Act, a decision can be overruled "when the minister considers it to be in the public interest".... (Article trancated)
