ASA Indonesia Submits Amicus Curiae for Kenny Sonda

Alumni Society of ALSA Indonesia (ASA Indonesia) expressed support for Kenny Wisha Sonda through Amicus Curiae (Friend of the Court). Amicus Curiae has been accepted by the South Jakarta District Court (PN Selatan), on Friday (20/9/2024).

Through a written statement, the General Chairperson of ASA Indonesia, Sonia Ramadhani Syukur, said that ASA Indonesia, which is an alumni of the Law Faculty of several State Universities who are active in the ALSA Indonesia organization, supports Kenny to be acquitted of all charges.

"In our view, it is not right for Ms. Kenny, who is an employee, to be charged with the right to make decisions for and on behalf of the company that is not her authority. Deputy Chairman of ASA Indonesia for Division 2, Chandra Agus Salim continued that Kenny's legal problem is a civil matter, not a criminal one. This is reflected in the indictment of the Public Prosecutor (JPU).

"If we look closely at the summary of the Public Prosecutor's Indictment obtained from the South District Court website, the indictment of the Public Prosecutor himself, the Public Prosecutor has been very clear and explicit that this case is an allegation of non-performance based on an agreement, so that if there is a legal problem concerning the fulfillment of performance on an agreement, then an examination will be carried out first absolutely in a civil court, no criminal examination will be carried out," said Chandra.

He also considered that Kenny did not have the authority to give orders to superiors, especially to the board of directors of a company, let alone make a decision for and on behalf of the company. What Kenny did was nothing more than giving advice as an employee to his superiors where the decision to do something and/or not to do something for and on behalf of the company is entirely the right and authority of the board of directors given by the company to him.
