Officials consider protection

THE Immigration Department would weigh up whether a Chinese diplomat would face persecution if he returned to his homeland when it assessed his claim for a protection visa, Foreign Minister Alexander Downer said today.
Chen Yonglin, 37, has appealed for asylum, saying he fears for his life following his walk-out from the Chinese Consulate-General in Sydney five days ago.
He came out of hiding to front a rally in Sydney yesterday, telling protesters the Chinese people had no political or religious freedom.
Mr Chen also said there were no human rights in China, that the Chinese Government had never admitted it had a human rights problem, and that the Government would one day be overthrown.
Speaking on Channel 9, Mr Downer said: "He's seeking a protection visa and obviously he's entitled to put his case to the Immigration Department and he's in the process of doing that, as I understand it.
"So that will be considered following the due process that always applies when people do seek a protection visa."
But he declined to be drawn further on the case, saying he did not want to get into a commentary about it because it was under consideration.
Asked if he believed Mr Chen would be persecuted if he returned to China, Mr Downer replied: "That's something the Immigration Department will obviously have to weigh up.
"And they'll have to take into account the implications of refusing his protection visa application and in those circumstances he'd be sent back to China," Mr Downer said.
"They'll have to weigh up the consequences of that against the bona fides of his application for protection."
Mr Downer said he was unaware of Mr Chen's claims the Chinese Government was kidnapping Chinese people in Australia and taking them back to China.
He refused to comment on claims by Mr Chen that there were 1000 Chinese spies operating in Australia, outnumbering Soviet spies in the country during the Cold War.
"It's a time-worn tradition of Australian Governments over many years not to get into any discussion about that aspect of intelligence matters," Mr Downer said.
"These are matters that are obviously considered by our intelligence agencies and we don't want to get into public discussion about them."
