It's not couriers saying appeal. It's asx ann:

and remain a detrimental influence over the optimal
development of the project. Expectations are that these
disputes will remain in the Courts for several years as
they progress through the trial and appeals process."

I don't think they are saying they expect to lose. Contrary, they expect to win. But why would Page give up when he has a right to appeal?
