I agree that Kloppers may have underestimated the obstacles to this merger, but I suspect that if it falls through, BHP sp will rise anyway.
Any 'enormous' break fees would be public knowledge by reason of continuous disclosure rules of material events.
When Kloppers visited Ravensthorpe he told the construction staff to be sure to tidy their desktops before they departed each night. This sowed a seed of doubt in my mind.
