Black J makes the following orders and directions:
1. Direct the Plaintiff to file and serve all further evidence on which it relies, and submissions, by
6pm today, 15 May 2023.
2. Direct the Defendant, and Ariv Global Sdn Bhd (“Ariv”) (so far as it seeks to be heard) to file and
serve their evidence, by 4pm on 18 May 2023, no evidence to be relied on if filed and served after
that date without leave.
3. Direct the Defendant and Ariv to file and serve their submissions by noon on 19 May 2023.
4. Reserve the question whether Ariv is to be heard under r 2.13 of the Supreme Court
(Corporations) Rules 1999 (NSW), or to be joined as a party to the proceedings, to the final hearing.
5. Direct the Plaintiff to file and serve any evidence, and any submissions in reply, by noon on 22
May 2023, no evidence to be relied on in reply if not filed and served by that time without leave.
6. Direct the parties to deliver a Court Book containing all pleadings, affidavits, exhibits and other
documents relied on, objections to evidence and submissions, to the Associate to Williams J by4pm on 22 May 2023.
7. List the matter for hearing before Williams J on 23 May 2023.
