The NRC has now published (on 28 Feb) the Hearing Order - as follows:
"In light of the foregoing, please take notice that a hearing will be conducted in this proceeding. The hearing will be governed by the informal hearing procedures set forth in 10 CFR part 2, Subparts C and L, 10 CFR 2.300-2.390, 2.1200-2.1213"
Therefore, the parties to the dispute have not (since the Feb 10th ASLB decision) been able to settle the dispute out of court and they have not agreed to an abbreviated Hearing under Subpart N.
Accordingly, the Hearing will now be conducted under subparts C and L (ie at the conclusion of the SEIS process) unless NRC staff and/or Strata are successful in their appeals.
