    I can't believe that this would be on the PEN site BEFORE it was discussed on the BLR site.

    PowerTech was also down 7%.

    Contrary to what the PEN cheer squad is expecting once the SML is recieved, imo.

    The SML issuance for PEN IS a much bigger issue than the SML issuance for Dewey.

    To make a post like that you want to be comparing (& here you are assuming) that you are comparing like with like.

    What does Powertech still have to do in order to mine.

    First congrats on getting the SML.

    However this was processed under different regimes.

    Hence issuance of the SML is not the final say for Powertech. You still have EPA & two state boards to sit....from Powertechs site

    Plus to date there has been no PA put in place as yet.

    Almost two dozen tribes insist they be allowed to take part in a survey of the entire property, but the company has only provided resources for non-Indian surveys of a much more limited scope.

    Together with the Oglala Sioux Tribe and several individuals, the Native American non-profits Owe Aku (Take Back the Way) and Defenders of the Black Hills, all have standing to argue in NRC hearings over the projects uranium recovery license.

    In addition to cultural resource clearance, among other things, the company also needs Class III or Class V Underground Injection Control permits from EPA for mine waste water disposal and a certificate of federal exemption from the Clean Water Act, since it cannot return mine water to baseline conditions.

    So in a nut shell, it is no wonder Powertech went back 7% despite getting the SML

    Contentions on ADAMS

    Contention 1A: Failure to Meet Applicable Legal Requirements Regarding Protection of Historical and Cultural Resources.

    Contention 1B: Failure to Involve or Consult All Interested Tribes as Required by Federal Law.

    Contention 2: Failure to Include Necessary Information for Adequate Determination of Baseline Ground Water Quality

    Contention 3: Failure to Include An Adequate Hydrogeological Analysis To Assess Potential Impacts to Groundwater

    Contention 4: Failure to Adequately Analyze Ground Water Quantity Impacts.

    The SML here is NOT the end of the process as it is for PEN. If all goes well all permits by years end, pending legal contentions outstanding.

    Now I can see My Alex decided that Dewey Burdock be classified as high risk & needs to spread the risk


    Now for PEN - PA is in the attorneys office for approval.

    The PA which PEN/ NRC & various Indian Tribes have been in discussion for some time has reached a point of agreement and the PA agreement is currently doing the rounds for signing. Upon signing, the SML will issue from the NRC as 106 is completed & Attorney will have signed.

    No further approvals or permits are required. Construction for all items can then ramp up.
