    A Judge should be assessing whether Paul Kent broke the law and committed affray, and then consider whether the mitigations such as the 5 broken ribs, collapsed lung, the near death experience and the effects of losing a job (a lesser mitigation as the Court should consider whether the defendant has the capacity to get another one) lessen the sentence.

    Affray is a very serious charge and in NSW, anyone guilty of such affray is liable for a sentence of up to 10 years imprisonment.
