Are these proceedings criminal proceedings?
If so the burden of proof is "beyond reasonable doubt". ASIC may struggle to get there.
If the ASIC action is a civil action then the burden is "balance of probabilities"
If it's a civil matter then it is a toss up I reackon.
But so what for NUIX?
If they are now entering a period of growth that we signed up for during the IPO then
the SP could well grow very strongly irrespective of the ASIC matter.
The class actions are covered by insurance.
