Another issue that Sheehy's legal team would face in arguing that he would (or even could) have been able to sell all of his shares at the top, is not just the timing issue. Any market expert would tell you that selling that many shares so quickly would exert negative pressure on the SP and so it's unlikely he would have done it. Or even could have done so without causing a massive drop. And the SP impact of any sales of so many shares over even a period of weeks near the high, while open to speculation, is certainly arguably a negative one. So this is yet another reason that any loss of opportunity damages are likely to be significantly discounted from the market high SP.My opinion only and do seek independent advice.
