I am sure that they will strongly enforce there rights to secure their debt, they are compelled to given their public statements and their "fiduciary duty" to the shareholders of SGH who have bankrolled the current $120m play.
Tax losses will be preserved regardless as NXS don't have significant tax losses, the tax losses are held in the controlled entities ie subsidiaries. The buyer of LT will not buy LT at asset level , they will buy the shares in the subsidiary Nexus Energy Vic P54 ??? From memory , yes they fail the continuity of ownership test but they pass the continuity of business test, so tax losses preserved, same with Crux.
The accounts we see are Consolidated, not NXS position as a company.
