If NXS do not satisfy conditions (which they haven't) the options are to repay the deposit at 15% interest, or give AED 11% of longtom.
I would say they may do the latter.
I believe it is NXS choice which option they choose.
Of course, this will only be enforced if a renegotiated deal is not reached.
