The appeal is not a retrial, it is an appeal, now to get to that Appeal they should have paid the $5mill yesterday

It sounds to me like the whole trial was a complete embarrassment for SMM

so if they paid the $5mil

They get to have their appeal hearing, but as with the attempt to uphold the injunction, the appeal could get thrown out on insufficient grounds for a retrial.

Therefore Axiom have retrieved their court costs and SMM LOSE FACE ONCE MORE plus $5mil

If they haven't paid then Axiom will have to sing for their costs going by SMM past record.
