I was referring to his political capital, and to his acceptance by the media. Up till this point, he could argue (albeit implausibly) that he was simply pursuing justice through the courts. But, to take the full 21 days for appeal, and then to appeal against a federal Justice on purely technical grounds (against an already technical appeal), is a bridge too far, even for the left-leaning mainstream media.

I think this decision from STT shows them up for what they are; opportunistic eco-zealots that exploit overly generous law to run their minority agenda.

I've just written to Brett Whitely asking him to regard this latest development as a case study that justifies the amendment of the EPBC Act, or at least the restriction of access to appeal rights to third parties (as per Will Hodgman's promises with respect to state laws).
