I believe the situatuion here in NZ in a case like this is that they have to have valid grounds to appeal - in other words they can lodge an appeal, but that is then evaluated to ascertain if it has any validity before the appeal is then accepted.
In Aust is the lodging of an appeal seperate to the appeal being accepted?
