I don't know why you think that the ASX are untouchable and infallible. Plenty of evidence here of petty little bureaucrats tripping over themselves in pursuit of ISX. Do you think our friends 'retirement' is a coincidence?
If I were a litigation funder, I'd be looking at probability of winning (which post Fed court case will firm considerably) vs size of potential damages.
Who has the money here? The tech minnow with it's $17m (less now surely) in the bank or the bloated monopolist with it's $600m+ ebitda?
The minnow's bank balance will cover costs whereas taking down the incumbent will pay for all the firms partners new Queenstown ski villas, and provide a nice scalp on the wall to walk by and laugh at as they walk in and out of the office.
