You need to ask KL why evidence was important, not me. He knows more about ASX's powers than I do. ASIC also said they didn't have a smoking gun. So perhaps you could direct some questions to ASIC too?
The conclusion here is simple: ISX could have easily been
investigated without being suspended, just like the 13 other examples given. That's the reason those examples were given. But ASX wanted the suspension and JK has said the true reason will be revealed in court eventually.
If listing rules clearly spell out circumstances under which you could suspend any listed entity, yet you go running to the regulator claiming you don't have the powers, doesn't it mean your powers don't permit suspending the entity
for the reasons you were thinking of at the time? And that's what the court is after.
