There are inconsistencies; that's probably why ISX wanted to narrow things down by waiting for ASX to commit to a certain path in their defence.
It means nothing that he was Chief Compliance Officer; any reasonable person would see something doesn't add up if, as of the day before the suspension, his hands were tied, yet claims to have suspended ISX the next day for those same reasons his hands were tied. The only thing new was a message from ASIC. How hard is it to work this out?
