Should a settlement be reached what will the repurcussions be toward ANZ for crushing sentiment in the aussie market? Who polices this? ASIC or ASX?

Is everyone forgetting how ANZ and Merril Lynch dumped all the Opes holding on the market before letting everyone know what had happended? Isn't there a requirement to disclose material information such as this, (lets not even go into beneficial ownership and ASIC notice issue here). Had ANZ and Merril announced what they were going to do they would not have been able to dump all the stock and would have realised much less... Sure market forces will correct the position in the long term, but how many have profited from this in the short term, and profited significantly.

What about all the insiders that knew what was about to happen to Opes and started selling (or went short on stock) before ANZ and Merril did their dumping? Has any action been taken in relation to those? This is ridiculous!

The regulators have fallen well short of what is expected. What would the US response have been to such an event? The retail perception of the market is that retail investor are welcome, as long as they don't make more money then those established in the industry such as ANZ and Merril.

What is ASIC doing? Well.... they are present in the mediation. WTF? This is like the police inviting you to a mediation with someone that robbed your house and and raped your wife while they were at it. To settle this the robber is willing to return you your telly and DVD in settlement (say 60% financial settlement) and asking you go away so that you don't have to go through the ordeal (and cost) of legal proceedings....
