So what does this ruling mean for cap gains tax?
Lets look at two scenarios:
1) Where I lodge shares in Opes: According to the ruling I lost title to the shares the day this happened. Therefore this should have triggered a CQT event. Is that right?
2) Where I buy new shares via Opes: According to the ruling I never had title to the shares so what the hell do I do in regards to CGT?
What a mess.
