I dont about ANZ unintentionally executing a "very successful shorting strategy" and benefitting from it. The Opes cases may run for years if appealed and no one knows where the market will be then!
In addition IF the court finds ANZ liable, it could be argued that ANZ in wrongly confiscating the shares held those shares in trust and under trust laws, one may become liable for the profit or the actual loss caused to the beneficiaries which ever is the greater.
These Opes cases are going to test new boundaries in many untested area of the laws.
