I think he means to imply that the Court didn't interpret the law correctly and didn't provide a clear explanation as to why creditors rights could be removed.
The Courts have relied on part of the law in ruling that the Scheme can remove the rights of creditors to sue third parties. This judge seems to be saying that the law relied upon to validate the Scheme does not provide any validity to the Scheme
