In 1978 ..it was amended and enhanced to include .."or is likely to mislead or deceive"

It was latter incorporated into Corporations and Securities Law

Legal practitioners slowly came to grips with it and it eventually became the litigation route of choice for the aggrieved

Basically ..it doesn't seek blame ...If there was an error (or factual misstatement) and that error was relied upon
The Onus basically reverses..
