The key issue as i see it is whether ANZ / ML staff knew, or should have known, about what Opes were representing to clients about the ownership of shares under the relevant lending / security agreements, and what the legal consequences are for ANZ / ML about any knowledge. I think most Opes clients aren't going to agree on a settlement (short of 100% restitution)until this question is answered. The most open forum for asnwering this question will the Beconwood case - obviously, I have no idea what's being said about this behind closed doors at the mediation.
