I think you will find that the issue will be what other verbal representations were made by OPES to clients.

If OPES said to clients that the client maintained ownership that could well over-ride the written agreement.

Some have claimed that ANZ themselves were present at meetings where clients were told this. Even more incriminating if this did happen.
