I personally am not sure of anything. My opinion is just based on what seems to be the situation as I see it. Rhe courts seem to be saying re: shareholders cannot stop ANZ selling what it has a legal right to do. And the most simplistic understanding of the Opes Business model, i.e. shareholders contribute their shares into a common pool in return for margin loans and Opes use the common pool of shares as collateral to borrow money for the margin loans.
My conclusion is ANZ are acting in their own (their shareholders) best interest to retrieve their funds as quickly as possible and everyone else can get st*ffed.
Would I act in this way if I wanted to retrieve a debt? It is a difficult one because I have lost money borrowed to people. It seems less than ethical and certainly without regard for the individual investors. The blame for the situation lies with Opes Management not ANZ in my opinion.
