Opes Prime is going to be referred to as an agent under the GSLA due to the pooling arrangement.
There are certain disclosures of agents that must be met. If this is the case, well Opes Prime was a lending agent of ANZ, Merril Lynch and Dresdner as the pricipal borrower of securities. This should have been fully disclosed in all their documentation that they were acting as an agent borrower and the parties named.
