My understanding is that ANZ did take out a new charge in the final days, which might be void due to being done so late. However, I also thought that it was a replacement, and ANZ already held another layer of security not effect by this.

However, one report I saw suggested that when ANZ took out its original security way back when, it failed to lodge the charge with ASIC. Under the Corps Act, a charge only is effective if lodged with ASIC within the proper time period, which is about 45 days I think.

I've just taken this from media reports, so could be wrong.
