In the end you will have to weigh up the potential damages claim that you would be giving up. This issue is not about share performance, its about being in the position you were before you were either mislead and deceived and or your shares stolen on the 27th.
Everything else like the fink judgement is not relevant to the decision process for creditors.
The bank would be very aware that any proceeding will not give a toss about the fink judgement and the amsla as they will attempt to prove it was abandoned.
In the end you will have to weigh up the potential damages claim...
