Its interesting you say that, but the only true fair date no matter if shares went up or down was the date all the creditors lost total control of their shares or portfolio. That is the only date that all creditors were on an even playing field.
Since that date, the market has determined everytone fate, good or bad.
The easiest solution would be to give creditors a choice of dates of 16th October or 27th March.
