The real question that needs to be asked of this proposal, is what criteria are FH going to use to assess whether someone has a valid damages claim to be able to use the 27th March date. This process could reduce the size of the total creditors proof of debt pool as those damages claims that fail have their proof of debts reduced to the 16th October date.
People have said because it was in the FSG, well I would dispute that as I dont think "The investor retains beneficial and economic ownership" was ever in an actual FSG.
So how are FH going to assess who is entitled to damages and who is not????????????
What will be the criteria given that they will be judge and jury on that process?????????????
