Anyone accepting 40c at March 08 can buy back all their shares back at today value, you may even have small change later at Oct 09.
Lots of mid caps and small caps have fallen over 90% and creditors who hold that shares will vote YES.
Only a handfull of creditors will only use 16 Oct 08 value and can claim 79c, as described by Michael West.
