These deals are coming out of the creditors back pockets. The litigation was a wate of time and all the cases from Slaters and IMF were struck out anyway.
The court thinks it is unfair that we all pay for the waste of time, and the only way to get them stuck out is to put pressure back on FH and ANZ with a group that really represents the creditors.
The litigators will still get paid as they have done a deal, but it does not mean that ANZ cannot top up the pool to bring creditors back into the 40c which they announced months ago.
