It is pre-discovery ..ANZ and ML threw everything they could at it to have it summarily dismissed
Fink has said ..though it will need to redrafted in some aspects ..he ruled discovery to proceed
S+G at the time of drafting ..didn't have access to anything from ANZ ..
Once they do ..the case will be fleshed out
Either ANZ knew or they didn't
They did..and the files and records and emails now have to be opened to S+G
(remember the e in email stands for evidence)
No one was thrown a bone ..i read the tone quite differently..
I read ANZ are toast ..and there are some questions about ML's level of knowledge ..the level of which will be subject to forensic examination
