We also know now that ANZ and ML are being put into a corner to reach a compensation outcome with creditors. This matter is never going to see a court room now, so chances are we will never get to find out how M&D and damages would have work out. The litigators are most likely going to settle before it gets to court.
How much will they be prepared to settle for less their cut?
Every one is blaming ASIC. Well IMO they have done a pretty good job of backing ANZ/ML into a corner and hanging a rope around their necks. It is not their job to determine what is the right restitution and commercial outcome, but they have provided a brillant platform to determine the right compensation if creditors ar not happy. But that is what voting is all about.
