The waiver has been granted on the basis that the likelihood of Option holders exercising their Options,
based on current ordinary share price levels, appears too remote to justify the cost of sending expiry
notices. However, if a substantial increase in the trading price of Cluff ordinary securities occurs before 30
November 2008 (specifically, if the share price exceeds 1.85 cents per share), then the ASX requires that
the Company must still send the Option expiry notice to Option holder.
