Man spared jail after having sex romp with posh school girls

When 29-year-old Namur Eduardo Herrera was flagged down by two teenage girls dressed in shorts and tanktops as he was driving home, he had no idea his little adventure would leave him fighting to stay out of jail.
The girls - who are both students at one of Perth’s most prestigious colleges - wanted alcohol and insisted they were 16, but they were really just 14, the District Court was told yesterday.
Prosecutor Katie White said the girls got into a car with Herrera in the early hours of February 11 and the group went to a nearby oval, where the girls were running around with their tops off and one of them performed oral sex on Herrera.
The following week, Herrera received sexually explicit text messages from the girls. He picked them up in Northbridge and took them to a friend’s house where the trio took part in a sex romp before the girls left him at 4.30am.
Yesterday, Herrera pleaded guilty to five charges of sexually penetrating the two girls, the charges relating to one act of sexual intercourse and four acts of oral sex.
He received a two-year suspended jail sentence.
But defence lawyer Lisa Boston suggested her client had suffered an injustice. She said the case was extraordinary because it was the girls who had acted in a predatory manner and insisted they were over 16.
Outside court, Ms Boston had a warning for all men.
“If you are more than 19 years of age, don’t even think about having sex with anyone about 16,” she said. “Even if they lie to you and tell you they are 16, if they are under 16 you have committed a criminal offence.”
Ms White said the law had been changed to exclude the defence of having an honest and reasonable belief about the girls’ age.
Now, if the accused was more than three years older than the victim, there was no defence to the charges.
Sentencing Herrera, Chief District Court Judge Antoinette Kennedy said though the girls claimed they were over 16, it must have been obvious to him they were very young. Vulnerable people needed to be protected from themselves and the onus was on the adult to make sure he knew a girl’s age.
Outside court, Herrera said he had not been aware of the law. Suggesting
that the girls were sexually experienced, he said: “I never asked for anything - they offered.”
He hoped the conviction would not result in him being deported to Chile.
“I think it’s a bit of an injustice,” Herrera added. “I think it’s going to happen to other people as well.”
Attorney-General Jim McGinty stood by changes he made to the Criminal Code three years ago which limited the defence of a reasonable mistake to offenders who were no more than three years older than the victim. He suggested Herrera was lucky to get a suspended jail term.
“The offender was more than twice the age of his young victim,” he said.
“We must do everything we can to protect our young people.”
