Another problem with regulating capital markets, is that if for example BYR or any company perceives the ASX to be tougher than it's competitors eg. TSX, AIM etc - they can just move to the softer exchanges.

Lack of regulation in US derivatives markets is exactly what lead to the pre-GFC property bubble there, collapse of Lehmann Brothers and then the carnage wrought on us poor innocents. Regulation of capital flows is a real catch 22.
